Passenger Transport Agreement
1. Parties
This Passenger Transport and Service Agreement (Agreement) is concluded between "Kings World Transfer COMPANY" operating at "Mecidiyeköy Mah. Raşit Rıza Sk. Yıldırım İş Hanı No: 3 İç Kapı No: 18 Şişli / İstanbul" and passengers who make reservations from www.kingsworldtransfer.com and/or on whose behalf reservations are made (hereinafter referred to as "Passenger").
Unless otherwise stated in this Agreement, "Kings World Transfer" and "Passenger" shall be referred to separately as "Party" and together as "Parties".
2. Subject
With this Agreement, the Parties have agreed within the framework of the following Agreement conditions on the provision of transfer services purchased by passengers in airport-address or address-airport directions for airport transfers within Turkey's borders before and after flights, with designated vehicles and the collection of this service at the specified price by "Kings World Transfer".
3. Service and Payment Information
- The contract price is specified in the service details including VAT.
- I accept that all fees for the transfer service I have received and/or will receive under this Agreement will be collected by Kings World Transfer with my credit card that I will enter on the IYZICO screen and I authorize Kings World Transfer to make the credit card withdrawal in this regard.
- The invoice preparation period for the purchased service is 7 days including the purchase date, provided that the month is not exceeded as required by V.U.K.
- Payment Method: Debit Card or Credit Card
4. General Provisions
- The passenger is obliged to act in accordance with all legislation, especially the Highway Traffic Law, and to behave in accordance with all rules within the framework of the legislation, especially wearing seat belts and complying with safety rules in the vehicle.
- When a passenger receives the transfer service they have received with a credit card or debit card, they have accepted the written terms of the relevant agreement even if they have not signed the user service agreement.
- The passenger must have made a reservation at least 2 hours before the transfer time to benefit from the transfer service subject to this Agreement. On religious and national holidays, New Year's Day and other official holidays, reservations must be made at least 24 hours before the transfer time. The reservation can be cancelled by the Passenger up to 24 hours before the transfer time. In this case, the service fee received by the Passenger is refunded. No fee refund is made for reservation cancellations made outside the specified periods.
- In all travel services, the passenger does not have the authority to change the route. The passenger's requests to stop at a different location between the determined route and to wait at this location for a while are not accepted. In VIP transfer service, different point requests requested outside the route(s) specified in the contract are charged for each different point.
- Kings World Transfer is obliged to allocate vehicles suitable for the number of passengers and luggage volume determined by the passenger when purchasing the transfer service. Kings World Transfer accepts and undertakes that all vehicles it will allocate to the service subject to this Agreement will have complete individual accident and seat insurance, that the vehicles' periodic maintenance will be carried out within their periods, and that materials such as spare tire, first aid materials, fire extinguisher, reflector that must be present in the vehicle will be available. In case of any traffic accident and other reasons that may occur during the transfer, if the customer suffers physical or material damage or the transported goods are damaged, Kings World Transfer will not be responsible for these damages. The customer accepts and declares in advance that Kings World Transfer will not have any responsibility arising from Article 66 of the Law of Obligations and other provisions of the legislation in such a case.
- Except for the passenger and luggage information reported by the passenger at the purchase stage being accepted by Kings World Transfer, passengers or luggage exceeding the limits accepted by Kings World Transfer cannot be accepted into the vehicle. If the passenger gives up the transfer service for this reason, no fee refund can be made.
- If necessary, the passenger is obliged to prove to the vehicle personnel who will carry out the passenger transfer that they are the customer who purchased the service, with identity documents issued by legal authorities and reservation documents. The transfer of customers who do not fulfill this obligation will not be made. However, Kings World Transfer may allow the Passenger to benefit from this service if it is convinced that the credit card holder who made the reservation consents to the Passenger receiving this service.
- Kings World Transfer is not responsible for the loss or damage of all items forgotten by the customer in the vehicle during the transfer. The passenger must urgently contact Kings World Transfer call center on the day they realize they have forgotten their belongings in the vehicle. If the forgotten item is found, the passenger is obliged to collect their belongings from the address notified to them. If the passenger requests, the forgotten item can be delivered to the address specified by the passenger by Kings World Transfer for a fee.
- Kings World Transfer does not accept sacks, crates, boxes, etc. as luggage in transfer vehicles. The passenger has the right to carry a maximum of 1 handbag and 1 suitcase per person (The handbag should weigh 8 kg, the passenger's accompanying suitcase should not exceed 32 kg). The passenger accepts, undertakes and declares that there are no flammable, explosive, narcotic, liquid, odorous, radioactive and any substances whose transportation and possession is prohibited by Turkish legislation in the luggage subject to transfer. If the presence of the substances listed in the luggage is noticed by the driver, the said luggage will not be accepted into the vehicle. Additionally, in such cases, the passenger cannot claim any debt or right against Kings World Transfer under any name. If the presence of the substances listed above is detected in the luggage, the situation will be immediately reported to the competent authorities by Kings World Transfer. If the presence of the listed substances is not noticed by the driver and is detected during the transfer when the vehicle is stopped and searched by law enforcement, all kinds of damage and loss that Kings World Transfer and/or any person will suffer for this reason will be immediately compensated in cash and immediately by the passenger.
- Passenger information:
- Reservation information or preliminary information about the service received by the passenger will be shared via email and/or SMS. The responsibility for the accuracy of the phone and email information provided by the passenger belongs to them. Kings World Transfer cannot be held responsible for the communication information being incorrect and the information not reaching the passenger.
- In shared transfers purchased, the estimated pickup time will be shared with the passenger via email and/or SMS 12 hours before the transfer. In VIP service, service will be provided according to the pickup and drop-off time that the passenger will determine themselves.
- In transfers from a certain point to the airport; Kings World Transfer declares and undertakes that the vehicle allocated for transfer will be at the designated point at the transfer time. Notification is made to the passenger via email and SMS before the determined transfer date and time. From the transfer time notified to the passenger, a 20-minute delay of the transfer vehicle will be considered a reasonable delay, except for extraordinary situations, unexpected circumstances, force majeure, flood, hail, rain, traffic congestion, etc. In transfer points such as sites, mass housing; Kings World Transfer is not responsible if the 20-minute delay period is exceeded due to site security guards preventing the vehicle from entering the site. If 20 minutes are exceeded in this way and the Passenger does not wait for the vehicle, no fee refund is made. The passenger must be ready at the designated point with their luggage at the transfer time. If the passenger is not ready at the transfer point at the transfer time, the vehicle allocated to Kings World Transfer is obliged to wait for the passenger for 5 minutes. If the passenger does not reach the designated point with their luggage within 5 minutes, the vehicle has no further waiting obligation. Time notifications from Kings World Transfer's operations, call center and drivers will be binding for the parties.
- In delays or waits exceeding 2 hours for any reason, Kings World Transfer's obligation to keep vehicles waiting at the airport is eliminated. In shared transfers, transfers are carried out by Kings World Transfer according to suitable time and vehicle availability. In VIP service, suitable vehicle is allocated by Kings World Transfer and service is provided.
- Due to operational reasons at airports, your vehicle will pick you up within a minimum of 10 minutes and a maximum of 20 minutes. In cases departing from address, there is a 15-minute delay right.
5. Cancellation - Refund Terms
- If the times specified in this Agreement expire and/or the conditions are not met, the right of cancellation cannot be used and Kings World Transfer does not make a fee refund.
- If you received your reservation from Kings World Transfer's website, mobile application or call center, you can perform your change and cancellation transactions with Reference Code and identity information from any of the online sales channels or call center.
- Kings World Transfer may cancel the reservation and/or transfer unilaterally for reasons such as unexpected circumstances, force majeure, natural disaster, hail, flood, traffic accident. In this case, no fee refund is made if there is no fault attributable to it.
- Passengers who make cancellation requests less than 24 hours before their transfer in Shared transfer, less than 24 hours before transfer in VIP transfer, or after the transfer time despite having a reservation are considered as passengers who did not participate in the transfer (no show). In this case, no fee refund is made.
- No cancellation, change or fee refund is made for any reason in promotional products purchased by the passenger.
- Material damage, commission fees, etc. obligations that will be imposed on Kings World Transfer by the Republic of Turkey State, bank or banks due to refund transactions of payments made with credit cards are deducted from the money to be refunded to the Passenger.
- Cancellations made in reservations purchased in installments are refunded to the card account where the payment was made in installments again.
- If the reservation is cancelled by Kings World Transfer for any reason, this situation will be notified to the Passenger as soon as possible.
- Rules to be followed in journeys made with Kings World Transfer:
- Not consuming alcohol and narcotic substances during travel in the vehicle
- Avoiding actions that would distract the driver
- Not talking loudly in the vehicle
- Not disturbing anyone by respecting the rights of other passengers
- Not eating during travel in the vehicle
- Avoiding actions that would endanger the safety of the journey
- Knowing and implementing the obligation to wear seat belts during travel
- Damaging the vehicle (If the passenger damages the vehicle, the damage cost will be invoiced to the passenger).
